（以下称“客户”），同意按照下列条款和条件, 在(野趣)居住, 从野趣乡居（野趣）租用自行车、头盔和其他设备（“设备”）。野趣乡居被定义并作为通过野趣乡居租赁自行车或其隶属的资产。活动被定义为客户通过野趣乡居或其隶属机构, 如登山、自行车骑行、汤泉、当地手工艺品制作和其他普通旅游项目。设备被定义为野趣乡居提供给客户的设施, 自行车租赁, 运动设备租赁和普通旅游等设备。客户确认已阅读并接受本租赁协议的条款，以及所附的风险承担，弃权及免责声明。客户接受设备的使用，需保持原状、清洁和良好状态，并在其租赁使用中对设备的维护承担全部责任。野趣乡居鼓励客户在开始骑车前检查自行车和设备，并可提出任何疑虑或问题。(hereafter, “the Customer”), understand and agree to the below items for their stay (Stay), for activities held in or nearby the Stay (Activities), equipment and rental of bicycles, helmets and other equipment as agreed (“the Equipment”) from Wildhomestay (Wildhomestay), in accordance with the terms and conditions listed below. The Stay is defined as short term rental of one of Wildhomestay or their affiliates properties. Activities are defined as experiences that the Customer partake in provided by Wildhomestay or one of their affiliates such as hiking, bicycle riding, dipping in pools, crafting local items, and general tourist actives. The Equipment is defined as the equipment provided in the Property, bikes rented, sports equipment rented and general tourist equipment provided by Wildhomestay to the Customer. The Customer confirm that they have read and accepted the terms of this Agreement, and the attached Assumption of Risk, Waiver and Release. The Customer accepts use of the Stay, Activities and Equipment, AS IS, clean and in good condition, and accepts full responsibility for care of the Equipment while under his/her possession. Customers are encouraged to check their equipment and raise any concerns before starting their Stay, Activity or rental Equipment period.
客户同意并了解野趣位于自然保护区周边，在入住野趣期间，需充分考虑野趣周边地区存在其特定的危险情况：包括野生动物，滑坡，高处跌落，野生的蛇虫，洪水，泥石流，糟糕的路况等。客户需对自身的安全，健康, 保护措施及个人物品负责。野趣乡居不会对客户的安全，健康状况，个人物品及财产承担责任. 客户在该地区旅行或参加活动都需要自担风险。野趣乡居对于客户在本民宿区域, 或其他人可能建议客户前往的一些地方参观或者活动时, 可能发生的健康疾病，意外或食物中毒等情况不承担责任。 由客户自行判断自己是否具备相匹配的技能，装备和水平来决定选择野趣乡居网站上介绍, 或客户以其他渠道了解议的其中一条路线或路径。野趣对于来往途中可能发生的任何危险及存在的风险不负任何法律责任。 客户租借野趣乡居的设备需自行承担风险。野趣乡居不提供旅游保险或个人财产保险。野趣乡居不建议任何时间内儿童在无人陪伴的情况在外活动，并且儿童也不适合在某些可能存在危险的地方奔跑，许多路面表面光滑，并且大多高处区域也并没有设置围栏。 请知悉，本区域内暂不适合轮椅通行，野趣乡居目前没有特殊的轮椅通道或设施。The Customer agrees to take considerable care in their Stay in that the village, around the nature reserve, roads and overall site. The area around Wildhomestay has its own unique dangers. These include wild animals, slippery surfaces, high drops, snake and animal bites, flooding, landslides, bad roads, etc. The Customer is responsible for their wellbeing and own safety, health, security, and belongings. Wildhomestay are in no way responsible for the Customers safety, health, personal valuables or belongings. The Customer Stays at their own risk and travel or partake in Activities in the area are at their own risk. Wildhomestay are not responsible for health issues, accidents or food poisoning around our area or other places they might suggest the Customer visits or do Activities in. It is up to the Customer to judge if they have the suitable skill, equipment, and level of understanding if they decide to follow one of the routes or trails that Wildhomestay suggest on their website or by other means. Wildhomestay are not responsible for travel to / from their homes in anyway and only suggest 3rd party means of transport. The Client borrows or rents Wildhomestays equipment at their own risk. Wildhomestay do not provide travel insurance or insure Customers or their belongings. Wildhomestay do not suggest children be unaccompanied nor should they run around in dangerous areas due to slippery surfaces, dangers which they are not accustomed to and high drops with no rails. Customers note the site is not suitable for wheelchair access and wildhomestay currently have no special needs access or facilities.
客户同意以安全和谨慎的方式操作设备。客户已经检查了设备，并确认它是在干净、安全和可用的条件下提供的，客户同意将以提供时相同条件, 在合理磨损的情况下，将其归还给野趣乡居。合理的磨损不包括因客户错误使用, 或撞车或第三方原因造成的情况。如果客户损坏了设备，客户同意支付给野趣乡居维修或更换设备的费用，其费用按照赔偿时的当前费率计算修理费用。The Customer agrees to operate the Equipment in a safe and prudent fashion. The Customer have inspected the Equipment and confirm that it has been provided to them in a clean, safe and usable condition, and the Customer agree that they will return it to Wildhomestay in the same condition it was provided to them in, subject to reasonable wear and tear. Reasonable wear and tear does not include broken items caused by the Customer or caused by misuse and/or crashes or a third party. If the Customer damages the Equipment, they agree to pay Wildhomestay costs to repair or replace the Equipment, which will be done at Wildhomestay discretion, and the Customer agree to pay Wildhomestay costs to replace parts, and to pay their current rates for repair, which are available to the customer at their request.

野趣乡居将为每辆出租自行车提供一个链锁式自行车锁。这把锁并不是为了防止有准备的专业窃贼，而是为了在白天处于低犯罪地区时, 提供最低限度的安全。在租赁期间不使用自行车时, 客户有责任谨慎选择一个安全的地方存放。如果租赁期间过夜，则需要找一个上锁的车棚、车库或自行车储物柜来存放自行车。根据租赁协议，丢失或被盗的自行车或设备, 将由野趣乡居决定以正常零售价置换。客户将在上报被盗后24小时内收到置换费用通知，并在向其信用卡收取置换费用之前提供置换费用估算。Wildhomestay for bike rental will provide one chain-style bike lock for each rental bicycle. This lock is not intended to keep out determined and professional thieves and is meant to provide minimum security during daylight hours in low crime areas. The Customer is responsible for using care in choosing a safe place to secure the bike when not in use during the rental period, and for having a locked shed, garage or bike locker to keep the bike if keeping rentals overnight. Bicycles or equipment which are lost or stolen while under a rental agreement will be replaced at Wildhomestays discretion at regular retail prices. The Customer will be notified of the replacement costs within 24 hours of the report of the theft and provided a cost estimate before charging replacement costs to their billing method or credit card.
客户理解并接受，租赁自行车或任何设备和参加自行车活动, 可能会使客户/客户的孩子面临许多危险，这些危险可能会导致不可避免的死亡、人身伤害（包括但不仅限于严重的脊椎或头部伤害）和财产损失或损坏。同时客户清楚理解客户/客户的孩子应在良好的身体健康状况下参加自行车活动，客户确认客户/客户的孩子没有不允许客户/客户的孩子参加自行车活动的严重的健康问题，或客户/客户的孩子也没有被诊断出有不允许客户/客户的孩子骑自行车的疾病。鉴于存在上述风险和认知，客户在此承担因租用本自行车和参加自行车活动, 而对客户自己/客户的孩子造成的伤害或生命损失以及财产损失或损坏的所有风险。客户清楚理解使用自行车租赁设备的内在风险，并对可能造成的任何和所有此类损坏或伤害承担全部责任。The Customer understands and accepts that renting Equipment or bicycles and participating in Activities or bicycling exposes them/their child to many hazards that may entail unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. The Customer also understand they/their child should be in good physical health to participate in Activities and bicycling, and the Customer confirm that they/their child have no significant health issues that prevent them/their child from participating in Activities or bicycling, nor have they/or their child been diagnosed with a condition that prevents them from the Activity or bicycling. In spite of the aforementioned risks and acknowledgements, the Customer hereby assume all risk of injury or loss of life to themselves /their child and loss of or damage to property arising out of renting this Equipment or bicycle and participating in the Activity or bicycling. The Customer understands the inherent risk involved in using this rental Equipment or bicycling equipment and accept full responsibility for any and all such damage or injury which may result.
考虑到野趣乡居租赁于客户/客户的孩子此设备或自行车，客户特此免除野趣及其附属单位、高管、代理和员工对客户/客户的孩子, 在租赁此设备或自行车, 或参加活动或骑行中可能遭受的伤害、疾病、死亡或财产损失或损坏的任何和所有责任或索赔。此项免责特别包括且不仅限于因野趣乡居或其附属单位、高管、代理或雇员的疏忽造成的伤害、疾病、死亡或损害的责任或索赔。此项均为客户本人意愿, 通过弃权和免责声明，免除野趣乡居并使其免受任何此类财产损失或损害、人身伤害或生命损失的所有责任，无论是由于野趣乡居的疏忽或是基于违反合同、违反保证，或任何其他法律条款。在签署本文件时，客户同意承担并保护野趣乡居及其所有者、雇员和代理免受客户、或代表客户或代表对客户负责的任何人提出的任何索赔，以及客户在调查和辩护此类索赔时可能产生的任何费用, 包括针对其律师与客户基础上的法律费用。客户完全认识到，如果客户/客户的孩子在租用自行车或参加自行车活动期间发生伤害、疾病、死亡或损坏，客户无权对野趣乡居或其附属单位、高管、代理或雇员提出索赔或提起诉讼，即使客户或任何人其中因疏忽造成客户的伤害/客户孩子的伤害、疾病、死亡或损害。In consideration of Wildhomestays renting the Customer/their child this Equipment or bicycle, the Customer specifically releases and forever discharges Wildhomestay and its affiliates, officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which the Customer or their child may suffer while renting this Equipment or bicycle and participating in the Activity or bicycling. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of Wildhomestay or its affiliates, officers, agents, or employees. It is the Customers intent by the Waiver and Release Agreement to release Wildhomestay and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence of Wildhomestay or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, the Customer hereby agree to indemnify and save harmless Wildhomestay, its owners, employees and agents, against any claims brought by me, or on my behalf or on behalf of any person for whom the Customer are responsible, and against any costs they may incur in investigating and defending such claims, including against their legal costs, on a solicitor and client basis. The Customer fully recognize that if injury, illness, death or damage occurs to them/their child while they am engaged in renting the Equipment or bicycle or participating in Activities or bicycling, the Customer will have no right to make a claim or file a lawsuit against Wildhomestay or its affiliates, officers, agents or employees, even if they or any of them negligently cause the Customer injury/their child’s injury, illness, death or damage.
客户已仔细阅读了本协议的全部内容，并理解其内容，客户知道有权让律师或其他专业人士对本租赁协议、风险承担、弃权和免责声明进行审查。客户知道这是一个风险承担，弃权和免责声明，并且自愿签署。客户也清楚理解，如果客户受到酒精或药物的影响，客户不应该也不可以参加任何活动。THE CUSTOMER HAVE CAREFULLY READ THIS AGREEMENT IN ITS ENTIRETY AND UNDERSTAND ITS CONTENT, AND THEY ARE AWARE THAT THEY HAVE A RIGHT TO HAVE THIS AGREEMENT, ASSUMPTION OF RISK, WAIVER AND RELEASE REVIEWED BY A LAWYER OR OTHER PROFESSIONAL. THEY ARE AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND THEY SIGN IT VOLUNTARILY. THEY ALSO UNDERSTAND THAT THEY SHOULD NOT AND MAY NOT PARTICIPATE IN ACTIVITIES IF THEY ARE UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
